Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer failed to ensure that an employee was protected while working in a Genie ML8388 aerial lift from the following conditions: a.At the east side of the building, approximately 18 feet in the air, an employee was working from a aerial lift without utilizing the required personal protective device. Reference: ANSI 92.5 - 1980 Boom-supported elevating work platform, Section 13.2.1 - The work platform shall be used only in accordance with the manufacturer's/owner's operating instructions and safety rules and Section 13.2.2 (6) - Check to see that all occupants' safety belts are on and properly attached. One feasible means of abatement is to make sure that the proper personal fall protection equipment required to do the job is provided and utilized.
