Nevada Revised Statute 618.375(1):  The employer did not furnish
employment and a place of
employment which was free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees:
The employer failed to ensure that a Fermec tractor loader's lifting
capacity was not exceeded
while lifting a concrete barrier rail:
a.A Fermec tractor, model #760, with backhoe and loader attachments was
utilized
at the job site, which was located on the west side of Green Valley
Parkway, just
South of the I-215.  The manufacturer's maximum suspended safe working load
in loader operations of 1000kg(2,200lbs), was significantly exceeded while
lifting
a concrete barrier, which weighted 5,850 lbs.  An employee's feet and legs
were
exposed to a crushing hazard while he guided the concrete barrier into
place.
REFERENCE: Fermec model 760 operator's manual,  page 28, which states "In
all instances, the maximum suspended safe working load in loader lifting
operations is 1,000kg, and page 112, which states "Loader Operation -
Warning -
Do not exceed the lifting capacity of the loader".
One feasible and acceptable method of abatement would be to ensure
operators
do not exceed the lifting capacity of the loader.
