Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to getting thrown out of the operator's seat and being crushed by the industrial lift truck: At the Forklift Maintenance Shop - On or about 10/30/2001, the employee that operated the Caterpillar lift truck, Model V30, Serial Number 5HB04261, did not use the seatbelt. Among other methods, one feasible and acceptable method would be to enforce the use of seatbelts on equipment that have seatbelts installed.
