Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the construction site located at 108 E. Highland in Jonesboro, an employee operating the Lull Highlander Model 6K-37, Serial #97X12V21-344 Rough Terrain Forklift was exposed to the hazard of crushing injuries due to the lack of use of a seat belt while using the forklift to aid in brick cleaning operations on the new building. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the operator to wear the seat belt provided in the power industrial truck. C & N Masonry, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 117972547, Citation Number 1, Item Number 1, issued on September 17, 2001, with respect to a workplace locate at 701 Napa Valley Drive in Little Rock, AR.k,
