Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: (a)Industrial Systems, Inc. & 545 Hwy 348, Delta, CO: On or before March 5, 2003, the exposing employer did not ensure that employees operating powered industrial trucks (forklifts) were provided with personal restraint devices (seat belts) during vehicle operation. This condition exposed employees to the hazard of being ejected from a Manitou Reach Chief forklift that was used at the shop facility, on the public highway and at field sites. Among other methods, one feasible and acceptable abatement method to correct is to: (a)Install/reinstall and train/retrain employees in accordance with ASME/ANSI B56.1-1993 Safety Standard for Low Lift and High Lift Trucks. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement-Certification Letter").
