Nevada Revised Statute 618.375(1):  The employer did not furnish
employment and a place of
employment which was free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees:
The employer failed to ensure that employees were not elevated, above the
roof of an apartment
building under construction, using a forklift:
a.At Building #2, an employee was elevated above a roof edge by a Skytrak
6036
forklift, to unload roof tile, while standing on a wooden pallet of roof
tiles.  The
employee was exposed to a fall of approximately 20 feet.
REFERENCE:  ASME B56.6B - 1998, Safety Standard for Rough Terrain Forklift
Trucks,
Paragraph 5.15.1 states:  "A ROUGH TERRAIN FORKLIFT TRUCK SHALL NOT BE USED
TO LIFT PEOPLE UNLESS THERE IS NO OTHER PRACTICAL OPTION."
ONE FEASIBLE MEANS OF ABATEMENT, AMONG OTHERS, WOULD BE TO USE A
LADDER TO ACCESS THE ROOF.
The employer failed to ensure that an appropriate personnel platform was
used to elevate an
employee above the roof of an apartment building under construction:
b.At Building #2, an employee was elevated on a Skytrak 6036 forklift
above the
roof edge on a wooden pallet of roof tiles.  The employee was exposed to a
fall
of approximately 20 feet.

Trucks,
Paragraph 5.15.1 states:  "IF A ROUGH TERRAIN FORKLIFT TRUCK MUST BE USED
TO
LIFT PEOPLE, THE FOLLOWING PRECAUTIONS FOR THE PROTECTION OF
PERSONNEL SHALL BE TAKEN:  (a) PROVIDE A PERSONNEL PLATFORM WHICH
COMPLIES WITH THE DESIGN REQUIREMENTS LISTED IN PART III OF THIS
STANDARD."
ONE FEASIBLE ABATEMENT METHOD, AMONG OTHERS, WOULD BE TO ENSURE
A PERSONNEL PLATFORM MEETING THE DESIGN REQUIREMENTS IN PART III OF
ASME B56.5b - 1998 IS USED.
