Nevada Revised Statute 618.375(1):  The employer did not furnish
employment and a place of
employment which was free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees:
The employer failed to ensure that an employee was protected from falling
while working in a
JLG Model 60H Aerial Work Platform at the following location:
a.South corner, East side of the building, Silverado Ranch Center
Project, approximately 15-17 feet high, an employee was working
from the aerial lift wearing a full body harness but was not tied
off/anchored to the bucket.  The lift was hit by a motor vehicle
and the employee was ejected from the bucket and fell onto the
windshield of said motor vehicle.
Reference:  ANSI/SIA A92.5-1992.  Boom-Supported Elevating Work Platforms.
Section 8.8:  During operation.  The aerial platform shall be used
in accordance with this standard.
Section 8.8(g):  Ensure all personnel in the platform are wearing
fall protection devices and other safety gear as required at all
times.

Foreword.  Item 5.  All personnel in the platform shall at all
times, wear approved fall protection devices and other safety gear
as required.
Section 1-6.  Operation.  Secure belt lanyard to proper attach bar
on platform.
One feasible means of abatement is to train/retrain employees on the
proper wear and anchorage
of personal fall protection equipment in accordance with ANSI A92.5 and
the operator's manual
for each lift before operating the lift.
