Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to falling loads:
(a)Frame/Chassis - On or about May 13, 2002, employees used a homemade
below-the-hook
lifting device, with a CM Lodestar hoist at each end, to lift steel beams.
This below-the-hook
lifting device consisted of vise-grip c-clamps attached by bolts and
chains to a yellow spreader
bar.  This below-the-hook lifting device had no permanently affixed
durable identification
stating the rated capacity, manufacturer, serial number, lifting device
weight, etc. and did not
receive all required inspections.
(b)Frame/Chassis - On or about May 13, 2002, employees used a homemade
below-the-hook
lifting device, with a CM Lodestar hoist, to lift axles.  This
below-the-hook lifting device
consisted of five sets of alloy steel chains suspended by bolts from a
steel frame.  Each chain
had a J-hook welded to the bottom of it.  This below-the-hook lifting
device had no
permanently affixed durable identification stating the rated capacity,
manufacturer, serial
number, lifting device weight, etc. and did not receive all required
inspections.
(c)Plumbing - On or about May 13, 2002, employees used a homemade
below-the-hook lifting
device, with a CM Lodestar hoist, to move furnaces, toilets, etc. between
the cabinet making
balcony and the plant floor.  This below-the-hook lifting device, which
looked like a
personnel-cage, had no permanently affixed durable identification stating
the manufacturer,
serial number, lifting device weight, etc. and did not receive all
required inspections.
(d)Plumbing - On or about May 13, 2002, employees used a homemade steel
frame below-the-
hook lifting device, with a CM Lodestar hoist, to move cabinets between
the
cabinet making
balcony and the plant floor.  This below-the-hook lifting device had no
permanently affixed
durable identification stating the manufacturer, serial number, lifting
device weight, etc. and
did not receive all required inspections.
(e)Sidewalls - On or about May 13, 2002, employees used a homemade
below-the-hook lifting
device, with CM Lodestar hoists, to move walls.  This below-the-hook
lifting device consisted
of a spreader bar with nylon web slings to attach the wall to the spreader
bar.  In at least two
places, welds, holding a stabilizer bar to the side of the spreader bar,
had broken, and in
another place, the stabilizer bar had a bend in it.  This below-the-hook
lifting device had no
permanently affixed durable identification stating the manufacturer,
serial number, lifting
device weight, etc. and did not receive all required inspections.
(f)Ceiling Jig/Paint Booth/Tie Down - On or about May 13, 2002, employees
used homemade
below-the-hook lifting devices (spreader bars), with CM Lodestar hoists,
to move ceilings.
These spreader bars had no permanently affixed durable identification
stating the manufacturer,
serial number, lifting device weight, etc. and did not receive all
required inspections.
(g)Ceiling Jig - On or about May 13, 2002, while an employee used CM
Lodestar hoists to lift
and move a ceiling from the Ceiling Jig to the Paint Booth, another
employee worked under
the suspended load, cleaning up the Ceiling Jig.
Among other methods, one feasible and acceptable abatement method to
correct these hazards include:
As specified in Below-the-Hook Lifting Devices, ANSI/ASME B30.20-1999,
using a nameplate or
other permanent marking, display the following information on each
below-the-hook lifting device:
Manufacturer's name and address, serial number, lifting device weight, if
over 100 pounds (45 kg),
and rated load.  Conduct frequent and periodic inspections of each
below-the-hook
lifting device, and
make an external code mark on each lifting device to indicate that the
periodic inspection occurred.
As specified in Overhead Hoists, ANSI B30.16-1973, hoist operators shall
avoid carrying loads over
people.g
