Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards up to thirty seven-feet: (a) Facility, Silo/Baghouse Area, Leetsdale, PA: On or about February 4, 2003, employees were exposed to a fall hazard up to approximately thirty seven feet while working from a 10' metal step ladder leaning against the silo, in that: 1) The stepladder was not fully opened and was leaning against the silo. 2) The stepladder was not secured against displacement. 3) The employee's upper body was extended to the left of the ladder in order to access the hatch opening in the silo, and was using a pry bar to clear material in the silo. 4) The top of the ladder did not extend above the top of the silo. 5) Employees had to use the top of the ladder to access the silo, which was approximately two feet below the top of the silo. Among other methods, one feasible and acceptable means to abate this hazard is to implement a ladder safety program as outlined in ANSI A14.2.ed
