Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of contact with a moving saw blade: a) West Fabrication Department - The Enco-360 band saws with serial numbers 37872 and 36986 were not equipped with magnetic restarts or similar devices, as prescribed by the American National Standards for Metal Cutting Saws, ANSI B11.10-1990, Section 5.2.3.4, that in the event of an interruption in the electrical supply would prevent the saws from restarting automatically when power is restored. A feasible means of abatement would be to provide a magnetic restarter or similar device as required by ANSI B11.10-1990. b) West Fabrication Department - The Enco-360 band saw with serial number 36986 was equipped with an unprotected toggle-type motor starter switch instead of a starter that was located, designed, constructed, interlocked, or guarded to protect against unintended operation, as prescribed by the American National Standards for Metal Cutting Saws, ANSI B11.10-1990, Section 5.2.3.1. A feasible means of abatement would be to provide a motor starter switch that meets the requirements of ANSI B11.10-1990. Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of contact with the closing stoke of a ram cycle/point of operation: a) The foot control on the Cincinnati 5 press brake was not protected as prescribed by the American National Standards for Power Press Brakes, ANSI B11.3-1982, Section 4.3.4.3., to inhibit accidental actuation by falling or moving objects, or by someone stepping on it. A feasible means of abatement would be to provide protection of the foot control mechanism as required by ANSI B11.3-1982. Abatement certification required for this item in accordance with 29 CFR 1903.19(c).
