Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment or a place of employment which was free from recognized hazards that are causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being struck by nails: (a)During the period of December 3, 2002 to June 3, 2003, employees working on the pallet repair line at Millwood, Inc. located at 5831 S. Pennsylvania Ave. in Cudahy, WI were not protected from fasteners i.e. nails, that deflected and/or were likely to deflect from Bostich pneumatic nail guns while driving nails into wood pallets that contained previously installed nails. Certification, with date and method of abatement required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
