Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of not wearing seatbelts while operating excavators and company vehicles: (a)Construction Site: On May 7, 2002, an employee was not able to retrieve the seat belt from behind the seat of the Caterpillar excavator, model 231D LC, serial number XINK00264X, which indicated the worker was not able to wear the seat belt while operating the excavator on the morning of this inspection. (b)Construction Site: On May 7, 2002, a foreman was observed not wearing a seat belt while operating the company pick up truck. AMONGST OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REQUIRE THE USE OF SEAT BELTS WHEN OPERATING HEAVY EQUIPMENT. Note: Abatement certification required for this item.
