Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Construction Site: The hazard of being struck by construction equipment operating beyond visual capacities without the use of a signalperson, sensing devices or visual/audible contact with personnel in the work zone. IN THE ALTERNATIVE: 29 CFR 1926.601(b)(4)(ii): The employer used motor vehicle equipment having an obstructed view to the rear and the vehicle was backed up without an observers signal that it was safe to do so: (a) Construction Site: The hazard of being struck by construction equipment operating beyond visual capacities without the use of a signalperson, sensing devices or visual/audible contact with personnel in the work zone.
