Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of not wearing seatbelts while operating powered industrial trucks: (A)Lumber Yard: On November 12, 2002, and at times prior thereto, the operator of the Toyota 6000 pound forklift, model number 02-SFG30, serial number 5FGU30-75205, was not wearing a seatbelt. (B)Lumber Yard: On November 12, 2002, and at times prior thereto, the operator of the Hyster forklift, model number H70C, serial number C5D11744R, was not wearing a seatbelt. AMONGST OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO CONTACT THE FORKLIFT MANUFACTURER TO OBTAIN A RETROFIT SEATBELT AND REQUIRE THE USE OF SEATBELTS WHEN OPERATING FORKLIFTS (POWERED INDUSTRIAL TRUCKS) THROUGHOUT THE ESTABLISHMENT AS REQUIRED BY ANSI/ASME B56.1, PARAGRAPH 5.3.19.
