General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with struck by and caught in between from moving cranes or other heavy equipment. Jobsite: D Street, South Boston, MA On March 24, 2003, an employee was fatally injured when he entered the swing radius of the Manitowoc 2900WC crawler crane. The crane swung and then traveled to its obstructed rear without giving advanced notice, and without receiving assurance from a spotter that rear of the crane was clear of all personal. The employee was pinned between the crane superstructure and its left rear track. One feasible means of abatement amongst others would be to have the operator, prior to moving the crane, ensure that all workers are outside of the swing radius, and wait for someone to signal the operator that the area is clear.
