Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to broken bones and crushing injuries from the hazards associated with a unstable counterweight for the caterpillar 375 excavator. Location: Job site. An employee was severley injured when the counterweight for the caterpillar 375 excavator tipped over and struck the employee on his leg. The excavator counterweight was placed on two pieces of dunnage in the mud and was not suffiecently braced during the installation process. Among other methods, one feasible and acceptable method would be to crib and brace the counterweight to prevent it from settling in the mud and tipping over.ng
