Section 5(a)(1) of the occupational safety and health act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of drowning and/or severe bodily injury were the excavator to inadvertently slip and/or be driven from the barge into the water with the operator in the cab: Location: On the barge located at Davol Street, Fall River, MA. The employees were exposed to drowning hazards when the excavator used for lifting and aligning sections of the pier was not positively secured. Among other methods, one feasible and acceptable method would be to secure the excavator to the barge with chains and binders.
