Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were causing or likely
to cause death or serious physical harm to employees in that employees
were exposed to:
At this facility:  Employees at this facility failed to use seatbelts
during their normal work activities.  Seatbelts
were provided on each of the 4 fork lifts observed being used during the
inspection of this facility and in each
case were not being used.  Fork lift operators normally load and unload
electrical transformers and their
components and are exposed to tip over hazards.  Recognition of the hazard
of forklift tip over and the need
for operators to use an operator restraint system is evidenced by certain
requirements in the more current
version of ANSI B56.1 consensus standard for powered industrial trucks,
and ASME B56.1-2000 - Safety
Standard for Low Lift and High Lift Trucks.
Abatement certification and abatement documentation is required for this
violation.  the
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful.  The
abatement certification sheet is enclosed with the citation(s).n
