Section 5(a)(1) of the Occupational Safety Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of falling while in the process of accessing the roof top. a.At the Ammonium refrigeration house, where an employee accessed the top of the roof, the employer did not ensure that the ladder was positioned three feet above the eve of the roof. On 05/04/2004, an employee was observed on the roof top of the ammonia refrigeration building (house). The employee used a fiber glass ladder (Model No. FE3224) to access the roof top that was 22 feet high from the ground. The ladder was positioned at the eave which exposed the employee to fall hazard while in the process of accessing the roof top. One method of abatement was to have a ladder that extends above three rung above the eave of the roof as required by the American National Standard for ladders - portable reinforced plastic - safety requirements (ANSI A14.51992, paragraph 9.3.10.
