North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The employer
did not furnish each of his employees conditions of employment and a place
of employment free from recognized
hazards that were causing or likely to cause death or serious physical
harm to employees in that employees were
exposed to:
Ref: American National Standard Z245.1-1992 paragraph 6.2.4
a)fall from moving vehicle - employees are not prohibited from riding rear
step of refuge trucks on
public streets when vehicle is moving in excess of 10 miles per hour or
traveling over 2/10 of a mile.
This condition was observed on August 20, 2002, while the vehicle was
observed moving in excess of
30 miles per hour and  traveling a distance in excess of 1/2 mile with a
employee riding the rear step.
Employer did not take necessary measures to assure compliance with
company's safety policy which
prohibits this practice.
Among other methods, one feasible and acceptable abatement to correct this
hazard is to monitor
employee compliance with this safety rule and utilize disciplinary policy
where necessary to assure
compliance.

a)hit by approaching traffic - employees collecting refuge containers were
not protected from oncoming
traffic by wearing bright, highly visible clothing.

hazard is to provide and
ensure employees wear highly visible clothing.
