North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Ref: US Department of Transportation Federal Highway Administration Standards and Guides for Traffic Controls. Sect. 6D-02 para: B and Sect. 6E.02 a)hit by approaching traffic - employees collecting refuge containers from curbside were not protected from oncoming traffic by wearing bright, highly visible clothing. Among other methods, one feasible and acceptable abatement method to correct this hazard is to monitor employee compliance with this safety and health rule as well as others and utilize a disciplinary policy where necessary to assure compliance. A-1 Sanitation Services, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent which was contained in OSH inspection 305722621, Citation One item 2, issued 09/17/2002.

Among other methods, one feasible and acceptable abatement method to correct this hazard is to monitor employee compliance with this and other safety rules on a regular basis, and utilize a disciplinary policy where necessary to assure compliance.
