Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed or struck by the approximately 15 feet long water pipe. a)Construction site: Hoyt and State Street, Brooklyn, N.Y. On or about 11/09/02 The employee assisting the operator was not protected from the danger of being crushed struck by the approximately 15th feet long water pipe being transported by the Caterpillar backhoe 3 4468 serial number 424. The water pipe was not secured by sling or any other safety device. Among other methods, a feasible and acceptable method to correct this hazard is to follow Caterpillar operation and maintenance manual Pg.# 62: a) Use short sling to prevent load swing. b) Attach the sling in the linkage holes on the back of the bucket. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
