Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to a deficient, poorly maintained and unsafe loader:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a un cargador deficiente, con pobre mantenimiento e inseguro:
a)At United Caribbean Containers/Owens Illinois of PR, a Caterpillar 910E
loader, serial
number 1YKDO207 used in the Cullet Hauler area for moving glass and glass
bottles to
other areas had several deficiencies: was not equipped with an operable
horn, seat belts,
a reverse signal alarm and lights for the night shift; modifications or
additions
were
performed by the employer without the manufacturer's approval; a Badger
multi purpose
dry chemical fire extinguisher Model 250MB-1, serial no. SY-726570 in the
unit was
discharged; and an inspection and maintenance program was not established
by the
employer. Among other methods, one feasible and acceptable abatement
method to
correct this hazard is remove the loader from use until the deficiencies
can be repaired
or the loader can be replaced. Establish and implement an inspection and
preventive
maintenance program to minimize the possibility of employees using unsafe
loaders.

a otras areas tenia varias deficiencias: no fue equipado con una bocina en
funcionamiento, cinturones de seguridad, alarma de aviso de reversa y
luces para el turno
de noche; modificaciones o adiciones fueron ejecutadas por el patrono sin
la aprobacion
del manufacturero; un extintor de polvo quimico seco Badger modelo
250MB-1, num.
de serie SY-726570 en la unidad estaba descargado; un programa de
mantenimiento e
inspeccion no fue establecido por el patrono. Entre otros metodos, un
metodo de
correccion factible y aceptable para corregir este riesgo es remover el
cargador de uso
hasta que las deficiencias puedan ser reparadas o el cargador sea
reemplazado. Establecer
e implantar un programa de inspecciones y mantenimiento preventivo para
minimizar la
posibilidad de que los empleados utilicen cargadores inseguros.
