Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard from the Genie lift:
(a)Fred Eshelman School, Millersville, Pennsylvania - An employee applying
stucco,
approximately fifteen (15) feet above the ground from the platform of the
Genie
lift was not wearing a personal fall arrest system (harness/lanyard) while
working
from the lift, on or about June 5, 2003.
VERIFICATION REQUIRED
Among other methods, one feasible and acceptable abatement method to
correct this hazard
includes using a personal fall arrest system with the lanyard attached to
the boom or basket of
the personnel lift, as outlined in the American National Standards
Institute
(ANSI) safety
standard for Boom-Supported Elevated Work Platforms (ANSI/SIA A92.5-1992).
OR IN THE ALTERNATIVE:
29 CFR 1926.453(b)(2)(v):  Employee body harness and lanyard assembly was
not attached to
the boom or basket when working from an aerial lift:
(a)Fred Eshelman School, Millersville, Pennsylvania - An employee applying
stucco,
approximately fifteen (15) feet above the ground from the platform of the
Genie
lift was not wearing a personal fall arrest system (harness/lanyard) while
working
from the lift, on or about June 5, 2003.
