Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employment and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to: An employee was exposed to
the hazard of being
struck or run over by a backhoe in the event that the employee riding on
the exterior of a
backhoe loader fell while the backhoe loader was in motion.
(a) The Views at Coleman Village, Roswell, GA - An employee was observed
standing/riding on the exterior of a rubber tired backhoe loader while it
was motion.The
employee was exposed to the injuries associated with being struck or run
over by the
backhoe loader.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
would be to develop and enforce a work rule prohibiting riders on
equipment that does not have
an place for a rider designated by the manufacturer of the equipment,
which is addressed in the
Society of Automotive Engineers Standard SAE J153 May 87, "Operator
Precautions", section
4.3.ion.
