Section (5) (a) (1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, in that employees working inside the excavation were exposed to a struck-by hazard while working near or under an irregularly shaped precast concrete head wall that could become unstable when lifted and set in place.   a.  New Publix Shopping Center, 5310 Matt Highway (369), Cumming, GA 30040 (Jobsite) - The employees working inside the excavation were exposed to a struck-by hazard while working near or under an irregularly shaped precast concrete head wall that could become unstable when lifted and set in place, on or about June 11, 2019.    Among other methods, acceptable abatement could include ensuring that riggers assigned to a load-handling activity must determine the weight of the load and its approximate center of gravity before rigging, select the proper rigging equipment and ensure the rigging configuration is sufficient for the load being lifted. Additionally, employees must be trained to recognized lifting and suspended load hazards and prohibited from standing in line with or next to the leg(s) of a sling that is under tension.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a.  New Publix Shopping Center, 5310 Matt Highway (369), Cumming, GA 30040 (Jobsite) - Employees were exposed to struck-by hazard.  The employer did not instruct employees in the recognition and avoidance of unsafe conditions, and hazards associated with lifting placing an irregularly shaped load, that may become unstable, in an elevated position; and the regulations applicable to his/her environment to control or eliminate hazardous conditions associated with setting concrete head wall, such as, but not limited to safe work distances when the excavator is setting the precast head wall, on or about June 11, 2019.     b.  New Publix Shopping Center, 5310 Matt Highway (369), Cumming, GA 30040 (Jobsite) - Employees were exposed to crushing hazard. The excavator operator was not trained to properly rig and lift an irregularly shaped load, such as a precast concrete head wall, in a manner that ensured it could be lifted and set in place without becoming unstable and falling onto employees handling the load or employees nearby, on or about June 11, 2019.
