Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees in and near weld stations #1, #3, and #6 were exposed to struck by hazards while operating the pneumatic, underhung hoists with no safety latch on the hooks. ANSI B30.16 - 2003, Section 16-1.2.9 requires that hooks shall be equipped with latches unless the use of the hatch creates a safety hazard. Also, Section 16-2.1.2 requires that frequent inspections of the hoist include an inspection of the hook latches for proper operation. Among other methods, feasible and effective methods to correct this hazard includes, but is not limited to: a.Install and maintain the appropriate safety latches on the lifting hooks; and, b.Perform frequent inspections of the hoists to ensure the appropriate function and safety features are present and operable.
