Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to contact with a rotating saw blade from a table saw that
was malfunctioning:
On July 20, 2004 the Ultamizer Model #S018LH, serial number 4, a cross-cut
"pop-up" saw
would raise up unexpectedly a second time after the initiated stroke was
completed.  The
employee positioned the wood and initiated the stroke by foot pedal.  The
saw stroked as normal
and then stroked again without an initiation or advanced warning.  The
uninitiated stroke of the
saw did not occur on a regular or anticipated basis. The saw blade was
guarded by a metal
barrier guard but the employee reached into the guard to retrieve scrap
pieces at the end cut.
The scraps were as small as 1/2 inch in width and at times were laying
across the inlet of the
saw.  When the operator removed the scraps he was exposed to the rotating
blade of the saw.
Among other means of abatement:
1.The saw could be corrected electrically to ensure uninitiated strokes do
not occur,
2.The employer could provide the employee with push sticks to remove
scraps and prevent
reaching into the guard,
3.The employer should provide training on use of the saw and purpose of
the guards,
4.And the employer should create and ensure compliance with workplace
policies that
forbid reaching into and passed guards.
The means of abatement should be in accordance with ANSI O1.1-1992, Safety
Requirements
for Woodworking Machinery, Sections 6.1.4 and 7.2.3.
ANSI O1.1-1992, Section 6.1.4: It shall be the responsibility of the
employer to
establish and follow a program of maintenance and inspection of a
woodworking
machine to ensure that all of the parts, auxiliary equipment, and
safeguards are
in safe operating condition.
ANSI O1.1-1992, Section 7.2.3:  It shall be the responsibility of the
employer to
train an operator in the proper use of any safety device such as a
fixture, tool, or
accessory required to do each operation safely and to supervise its use to
minimize the possibility of an injury.
