29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about March 19, 2019, the employer did not administer a continuing, effective hearing conservation program that included noise monitoring, training, audiometric testing and recordkeeping for employees engaged in wood pallet repair and manufacturing: On March 19, 2019, employee #1 was exposed to continuous noise levels at 68.79 percent of the permissible daily exposure, or an equivalent sound level of approximately 87.3 dBA, during the 504-minute sampling period. On March 19, 2019, employee #2 was exposed to continuous noise levels at 101.8 percent of the permissible daily exposure, or an equivalent sound level of approximately 90.1 dBA, during the 473-minute sampling period. Exposure calculations include a zero increment of 7 minutes not sampled. On March 19, 2019, employee #3 was exposed to continuous noise levels at 119.3 percent of the permissible daily exposure, or an equivalent sound level of approximately 91.3 dBA, during the 479-minute sampling period. Exposure calculations include a zero increment of 1 minute not sampled. On March 19, 2019, employee #4 was exposed to continuous noise levels at 61.63 percent of the permissible daily exposure, or an equivalent sound level of approximately 86.5 dBA, during the 500-minute sampling period. On March 19, 2019, employee #5 was exposed to continuous noise levels at 82.79 percent of the permissible daily exposure, or an equivalent sound level of approximately 88.6 dBA, during the 500-minute sampling period.
