Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: a. West side. Rough terrain forklift platform did not have restraining means such as guardrails on opensides. b. West side. Rough terrain forklift platform did not have weight of platform and maximium capacity marked on the platform. Among feasible abatement means is to comply with the American National Standards Institute B56.6 Safety Standard for Rough Terrian Forklift Trucks and provide guardrails and capacity information.
