OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    An employee was exposed to the hazard of falling 8 feet 8 inches to the ground below while installing soffit and fascia from an improper platform which had been lifted from ground level to roof level on the forks of a Gehl, Model Number RS8-42, rough terrain fork lift.

Employees using the scaffold were not trained by a competent person to recognize any hazards associated the scaffolding being used.
