Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to: Engine room: On or about June 25, 2003, the engine room presented the following hazards to employees: 1. It contained a gas-fired water heater with an open flame that used combustion air from within the engine room. 2. The mechanical equipment in the engine room was not provided with a remote control located immediately outside the machinery room door solely for the purpose of shutting down the equipment in case of an emergency. 3. The ventilation fans for the engine room did not have a control switch located immediately outside the engine room door. 4. A door communicating with the engine room was not tight fitting and self-closing. 5. Emergency shut-down procedures, including precautions to be taken in case of a breakdown or leak, were not posted posted outside the engine room immediately adjacent to each door. Feasible methods of abatement include, but are not limited to, complying with ANSI/ASHRAE Safety Code for Mechanical Refrigeration (15-2001).
