Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by flying steel bars while working/walking in the shear packaging area behind the one inch Stamco shear. a. Bay 5 - On or about October 7, 2003, four solid steel bars were placed in holes on the shear packaging platform behind the Stamco shear in order to keep the steel sheets from sliding off the packaging platform. The steel bars can be knocked out of the platform holes when hit by the steel sheets thereby exposing employees to the hazard of being struck by flying steel bars. A feasible method of abatement is to adjust the holes in the packaging platform in order to have a tight fit when the steel bars are placed in the holes of the packaging platform.
