Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that the
employees were exposed to stuck by hazards:
On January 19, 2004, two employees of Copycat Inc. were making a delivery
to the Mutual of
Omaha unloading docks at 3314 Farnam Street Omaha, NE 68175. The driver of
the Ford
(E350) panel truck, NE license number NMS718 backed into the co-worker
breaking both of his
legs.
Feasible and useful methods to correct this hazard, include but are not
limited to: (a) install a
backup alarm, (b) develop a written procedure for safe van positioning and
unloading under a
variety of conditions, (c) train employees on safe van positioning and
unloading and on the
written procedure.
Abatement certification is required for this violation. The abatement
certification sheet is
enclosed with the citations.ion
