29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communicationprogram which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning,material safety data sheets, and employee information and training will be met, and which also includes the following: The employer is failing to protect employees from potential hazardous chemical hazards associated with having employees work with hazardous chemicals without having developed a written HAZCOM program that outlines the methods to perform those duties. This was most recently evident during the inspection of the facility located at 1501 Howard Street, Omaha, NE 68102, where the employer has untrained employees using various chemicals to print and copy documents for customers and has not developed a written HAZCOM program that outlines the methods to train, label, store, distribute, use or protect the employees.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals intheir work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trainedabout is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability,carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety datasheets. The employer is failing to provide employees with HAZCOM training. This was most recently evident during the inspection of the facility located at 1501 Howard Street, Omaha, NE 68102, where the employer has untrained employees using various chemicals to print and copy documents for customers. Instances include but are not limited to: i. Inadequately trained employees using Hydoro-Aid Metering roller Wash to clean the rollers off the printers during use.
