Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
Throughout the facilities in the vicinity of the job site located at 2101
Ashland Ave., Beatrice,
NE 68310-The employer failed to furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to: The hazard of falling from
the elevated
working platform of a Gopher lift.
An employee fell from the elevated working platform of a Gopher lift due
to the lack of fall
protection usage.
Among other methods, one feasible and acceptable method to control the
hazard is to:
a)Develop and implement written procedures as per ASME Standard
B56.1-2000,(General
Safety Practices 4.17.2 (c)), requiring fall protection (restraining
devices) whenever a
powered industrial truck is used to elevate personnel.
b)Develop and implement a disciplinary action and procedures to ensure
that employees
wear fall protection while operating these vehicles.
Abatement certification and abatement documentation is required for this
violation. The
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful. The abatement
certification sheet is enclosed with the citation.
