Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The operator of a "Raymond" center rider, low lift order picker truck, did not have a label or symbol affixed to the truck, indicating the truck is equipped with a coasting system. this requirement is found in ASME B56.1-1993, Safety Standard For Low Lift and High Lift Trucks. This exposed a dismounted operator to the hazard of being struck-by a coasting truck on or about 05/28/03 in the warehouse.
