Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of crushing or impact injuries from industrial truck accidents: (a) Location - Yard: On or about May 14, 2004, employees operating powered industrial trucks were exposed to the hazards of being thrown off the fork truck. One feasible and acceptable method to correct this hazard is to ensure operators wear the supplied seat belts while operating the fork trucks at all times.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of falling from elevations: (a) Location - Block Cutting Building: On or about May 14, 2004, employees were working on a overhead crane while standing on a pallet lifted approximately 18 feet above grade without the use of fall protection. One feasible and acceptable method to correct this hazard is to use other properly designed and approved personnel lifting equipment with proper fall protection devices.on
