Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from or crushed by the fork truck. Location - Yard On or about 05/25/2005, employees operating powered industrial trucks were exposed to the hazards of being thrown off or crushed by the fork truck in the event of an accident. The Atlantic Stone Company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 5(a)1 of the Occupational Safety and Health act which was contained in OSHA Inspection 306101460, Citation Number 1, Item Number 1, Issued on September 29, 2004 with respect to a work site located at 896 Boston Post Road, Marlborough, MA 01752.rough,
