Section 5(a)(1) of the Occupational Safety and Health Act:  The employer
did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
Employees were exposed to hazards associated with a fall from or with a
reinforced plastic
stepladder that was improperly used.  The stepladder was used to access an
upper floor, which
required the employee to step on the top step and not have anything to
hold on to while climbing
to the upper floor storage space.
Among other methods, feasible and acceptable abatement methods to correct
this hazard would
be to:
Comply with ANSI A14.5 1992 American National Standard for Ladders -
Portable Reinforced
Plastic - Safety Requirements:  9.3.1 Ladder use shall be restricted to
the
purpose for which the
ladder is designed; 9.3.2 The user shall not step or stand higher than the
step or rung indicated
on the label marking the highest standing level of a ladder; and 9.3.6
Portable ladders are not
designed for excessive side loading, and such abuse of the ladder shall be
avoided.
