Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees are exposed to hazards associated with a fall from a reinforced plastic step ladder that was improperly used. The step ladder is not fully extended and leaned against the wall to access material stored on an upper floor. Among other methods, feasible and acceptable abatement methods to correct this hazard would be to: Comply with ANSI A14.5 1992 American National Standard for Ladders-Portable Reinforced Plastic-Safety Requirements: 9.3.1 Ladder use shall be restricted to the purpose for which the ladder is designed; 9.3.13.2 Stepladders users shall ensure that the stepladder is fully open with spreaders locked and all feet contacting a firm level support surface.
