Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of operating a Kawasaki Loader 95Z IV without
the following
safety features:
a) The loader did not have a seatbelt available for the operator's safety.
This is standard
equipment on the Kawasaki Loader 95Z IV.
b) The loader did not have a backup alarm available to warn workers of the
location of
this heavy piece of equipment.
Feasible and acceptable abatement methods are as follows:
a)The employer should order a seatbelt kit/assembly from the manufacturer
and install
it per manufacturer's specification.
b)The employer should order a backup alarm or reconnect the existing alarm
per
manufacturer's specifications.
