Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were not utilizing the forklift operator restraint system (seat belts),
exposing employees to
crushing injuries in the event that the forklift tipped over.
At the construction site located at 47 McElhannon Rd, in Bethlehem, Ga. on
or about 4/16/04:
a)A driver making a delivery to the rear of the building was observed
operating a Moffett
Mounty forklift while not wearing a seat belt;
b)A driver was observed making a delivery to the side of the building, was
observed
operating a Moffet Mounty forklift without wearing a seat belt.  The
electronic switch
designed to disable the forklift if the seat belt is not worn was not
functioning.
A feasible and acceptable method of abatement to correct this hazard is to
ensure that all
employees wear seat belts as required by ANSI B56.1, the consensus
standard for powered
industrial trucks, and ASME B56.1-2000-Safety Standard for Low Lift and
High Lift Trucks.
