Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
a place of employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall while operating unsafe motorized equipment with
defects:
a). On July 8, 2004, and times prior, two Caterpillar 826 Landfill
Compactors were missing the
ladders for accessing the cab. Subsequently, personnel were climbing on
the equipment to access
the operators cab and were exposed to fall hazards of approximately 7 feet.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is:
a). Make repairs.
b). Train personnel on page 9 of the Operations and Maintenance manual,
which states:  "Mount
and dismount the machine only where steps and/or handholds are provided".
c). Set up a maintenance program including routine inspections, daily
operator checklist, and
employee training to recognize hazards and correct them promptly.
