Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being injured in a equipment
accident where
service brakes were not functional or maintained.
a)On or about May 17, 2006, and at times prior, employees involved in
landfill
operations were exposed to injuries where Caterpillar Scrapers and
Compactors were
operated without service brakes.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to meet the minimum performance criteria for brake systems by equipping
each piece of
equipment with service brakes, in accordance with the following documents:
a)Caterpillar Operation and Maintenance Manual for 627B Wheel Tractor
Scraper, and;
b)Caterpillar Operation and Maintenance Manual for 824C Wheel Tractor & 825
& 825C Compactors.
