Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:On or about 04/17/03 Equipment:Caterpillar Front End Loader Model #953C, Serial #2ZN02115 Condition:Employee was permitted to use the bucket of the equipment to access his work area 8' above the ground. Among other methods, one feasible and acceptable abatement method to correct this hazard is to prohibit the use of earthmoving equipment to elevate workers and provide a safe means of access such as but not limited to a ladder. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
