Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD:
a)Roasting Dept., Grinder #1 on or about 1/15/04: Employees using a Dayton
1/2 ton rated electric chain hoist to lift "Whoppers"nylon mesh bags
containing approximately 500 lbs. of ground coffee. Hoist was not being
inspected using the frequent and periodic procedures as specified in
American
Society of Mechanical Engineers ASME B30.16-1993.
ABATEMENT NOTE: One means of abatement would be to ensure that the
Dayton chain hoist be inspected per American Society of Mechanical
Engineers, ASME B30.16-1993, Chapter 16-2, Sections 16-2.1.1, 16-2.1.2 and
16-2.1.3.
b)Mezzanine Area, on or about 1/16/04: Employees using a Budget one ton
electric chain hoist to lift "Whoppers" nylon mesh bags containing
approximately 300 lbs. of coffee beans. Hoist was not being inspected using
the frequent and periodic procedures as specified in American Society of
Mechanical Engineers ASME B30.16-1993.
ABATEMENT NOTE: One means of abatement would be to ensure that the
Budget chain hoist be inspected per American Society of Mechanical
Engineers, ASME B30.16-1993, Chapter 16-2, Sections 16-2.1.1, 16-2.1.2 and
16-2.1.3.
c)Roasting Dept., Grinder #1 on or about 1/15/04: The supporting structure
including monorail for the Dayton 1/2 ton electric chain hoist was not
designed nor rated to withstand the loads and forces imposed by the hoist
for
the rated load.Hoist is used by employees to lift nylon mesh bags
(Whoppers)
containing ground coffee.
ABATEMENT NOTE: One means of abatement would be to have a qualified
person review the design of the supporting structure and establish rated
load
capacity as per American Society of Mechanical Engineers ASME B30.16-
1993, Chapter 16-1, Section 16-1.3.2.
d)Roasting Dept., Grinder #1 on or about 1/15/04: One below-the-hook
lifting
device used to support nylon mesh bags containing ground coffee and attach
said load to the Dayton 1/2 ton electric chain hoist was not marked as to
its
rated capacity.
ABATEMENT NOTE: One means of abatement is to have a qualified person
review the design of the below-the-hook lifting device and have its
establishedcapacity marked on the device per American Society of
Mechanical Engineers
ASME B30.20-1993, Chapter 20-1, Section 20-1.2.1.
e)Mezzanine Area, on or about 1/16/04: One below-the-hook lifting device
used
to support nylon mesh bags containing coffee beans and attach said load to
a Budget one ton electric chain hoist was not marked as to its capacity.
ABATEMENT NOTE: One means of abatement is to have a qualified person
review the design of the below-the-hook lifting device and have its
established
capacity marked on the device per American Society of Mechanical Engineers
ASME B30.20-1993, Chapter 20-1, Section 20-1.2.1.

device used to support nylon mesh bags containing ground coffee and attach
said load to a Dayton electric chain hoist was not being inspected using
