Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the load should the overhead hoist or below-the- hook lifting devices fail: a)Throughout the facility, on or about 3/11/04: Overhead hoists were not being inspected on a frequent or periodic basis. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Conduct frequent and periodic inspections of the hoists for wear, deterioration and malfunction as per ASME B30.16-1993 Section 16-2.1. b)Maintenance Shop, on or about 3/11/04: A Dayton, one ton overhead hoist had a damaged safety latch on the lifting hook. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Install a new safety latch on the lifting hook in accordance with ASME B30.16-1993 Section 16-1.2.9. c)Brine Room, on or about 3/11/04: Two below-the-hook lifting devices used for lifting cheese cages had no rated load capacity marking. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Mark the rated load of the lifting device on the main structure or equivalent in accordance with ASME B30.20-1993, Section 20-1.2.1. Abatement certification must be submitted for these items.

Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Certify the anchorage support beam in accordance with ANSI Z359.1-1992, Section 3.2.5.1. Abatement certification must be submitted for this item.
