Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards of falling through the roof deck
while
walking/working on the roof or being struck by a roof collapse while
working under the
roof:
The wooden roof joists and plywood roof sheeting was damaged, decayed and
rotten. There
were openings in the rubber roof membrane that allowed rain water to enter
and wet the
wooden roof structure. Sand and gravel which fell from the overhead
conveyor belts
accumulated on the roof. This created a significant superimposed load on
the roof structure.
One feasible method of abatement is to make modifications to the design
and operation of the
conveyor system to minimize the amount of sand and gravel that falls onto
the roof. Have a
qualified structural engineer determine what repairs and/or modifications
need to be done so
the roof can safely support all anticipated loads. Have qualified
personnel complete repairs in
accordance with the structural engineer's recommendations.
