Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (A)The hazard of being thrown and crushed while operating a JOHN DEERE 310 D Loader Backhoe while not using a seat belt at the Boise State University Residence Halls project. NOTES : (1) One method available to abate this hazard is to wear the installed seat belt. (2) Abatement certification or documentation is NOT required for this item.
